Reading Russian citizenship eligibility: legal capacity and medical discharge
How legal capacity differs from medically unfit discharge in the official service categories, and why eligibility still requires an application decision.
Legal capacity and medical fitness describe different things
How should a reader understand an explanation that mentions legally capable applicants and discharge on medically unfit grounds? Those expressions qualify different parts of the service categories. Reading legal capacity as physical fitness would change the meaning of the official explanation.
The Far Eastern Federal District prosecution service describes foreign or stateless, legally capable men aged 18 to 65 years. Within those categories, it includes discharge after 24 February 2022 on medically unfit grounds. The health wording is a specified ground for discharge, not a substitute for the other conditions.
The same discharge category also names reaching the age limit and expiry of conscript-service or contract terms. It cannot be reduced to having left service for an unspecified reason. Citizens of Belarus are excluded from this procedure.
The explanation separately covers a contract signed after 24 February 2022 for at least 1 year or until the end of mobilization, the lifting of martial law or the end of wartime. For an earlier contract, it requires service during the special military operation period. These are the service circumstances to read alongside the description of the applicant.
A qualifying circumstance still needs an application decision
The distinction between an applicant description and a service circumstance is part of reading eligibility; it does not settle the application. Territorial bodies of the Russian Interior Ministry, MVD, review applications. The official explanation separates an application, a positive decision and receiving a passport. A contract is not an automatic passport, and a promise from an intermediary cannot replace the official decision.
Spouses, children including adopted children, and parents of people in the specified categories may also be covered, including relatives of those who have died. Their possibility depends on their circumstances; the male age description for the service categories is not a general description of these family members.
For the rule being discussed, the Tyumen prosecution service explains that Decree 821, signed on 5 November 2025, established a temporary citizenship procedure. Decree 10 of 4 January 2024 and its amending act ceased to have effect.
Practical questions for the territorial MVD office are: which requirements apply to this case now, which documents establish the category or family relationship, and where should the application be submitted? These are individual questions to confirm, not a legal document checklist.
